Credit Terms

At Pan American Nursery Products, we value clear communication, dependable service, and strong working relationships with our customers. The following terms and conditions are intended to help ensure orders are processed, shipped, received, and paid for as smoothly as possible.

Minimum Order
Our minimum order is $2,500.00. Orders under $2,500.00 may be subject to a $100.00 administration fee.

Account Terms
The following terms apply to all customer accounts:

  1. New Accounts

    New accounts may be asked to provide prepayment or post-dated cheques for a minimum of one year, or until credit has been reviewed and approved by our credit department. Advance payment is requested no later than two weeks prior to the scheduled shipping date.

  2. Established Accounts

    Approved established accounts are generally offered Net 30 payment terms, with payment due within 30 days of the invoice date. If an order exceeds the customer’s approved credit limit, the amount above the credit limit may require prepayment.

  3. Volume Discounts

    To qualify for any applicable volume discounts, payment must be received by our office within 30 days of the invoice date. Discounts apply to the invoice subtotal only. Taxes and freight are not eligible for discount.

  4. Overdue Accounts

    Payments received after the due date may be subject to a service charge of 1.5% per month on the overdue balance.

  5. Credit Privileges

    Repeated or extended overdue payment may result in a review or suspension of credit privileges. Accounts more than 90 days past due may be referred to a collection agency.

  6. Returned Payments

    Cheques returned due to insufficient funds will be subject to a $35.00 NSF charge, along with any applicable service charges noted above.

  7. Order Changes and Cancellations

    Cancellations or changes to orders must be submitted in writing to our office by January 1 and no later than 30 days prior to the requested shipping date. A restocking charge of 20% may apply to cancelled orders. Specialized orders may be subject to a restocking charge of 50%.

 

Orders and Shipping
We encourage customers to place orders well in advance to reserve quantities and help ensure delivery within the requested shipping window.

All orders are acknowledged subject to crop availability and growing conditions. While every effort is made to fulfill orders as confirmed, orders are accepted without liability for non-performance caused by crop failure, weather, growing conditions, shortages, or other circumstances beyond our reasonable control.

Customers are asked to provide clear and complete shipping instructions with each order. If no shipping instructions are provided, Pan American Nursery Products will use its best judgment in arranging shipment; however, we cannot assume responsibility for issues resulting from incomplete or missing shipping instructions.

Pan American Nursery Products sells many items as mixed collections. As a result, we are unable to accommodate special varietal or colour requests unless specifically confirmed in writing. Varieties within a collection may vary, and no specific variety within a mixed collection is guaranteed.

Claims and Adjustments
We are committed to working with customers in a fair and timely manner when concerns arise. To help us review and respond properly, all claims must be submitted within the timelines below.

Quantity Discrepancies
Any discrepancy in quantity must be reported in writing to our office within 14 days of receiving the shipment.

Quality Concerns
Quality concerns for potted product must be submitted in writing within 14 days of receiving the shipment and must include clear supporting images.

Freight and Shipping Damage
All collect shipments travel at the customer’s risk. If an order is damaged while in transit, the customer is responsible for filing a claim with the carrier as soon as possible.

Please notify Pan American Nursery Products immediately so we can provide any reasonable assistance available.
Because we have no control over the product environment once it leaves our premises, we are unable to accept returns or claims for merchandise that has been damaged, frozen, neglected, delayed, or overgrown after shipment.

Pan American Nursery Products Inc. will not be liable for any amount greater than the original purchase price of the nursery stock in question.

All claims will be reviewed and handled as promptly as possible.

Please note that claims may not be considered if the account is past due.

Collections
Pan American Nursery Products Inc. retains a security interest in all plant material until payment has been received in full.
If collection action becomes necessary, the buyer agrees to be responsible for reasonable costs incurred in collecting the outstanding amount, including collection fees, court costs, and reasonable legal fees, whether or not the matter proceeds to final judgment.

This agreement shall be governed by the laws of province of British Columbia.
